Terms of Service

Payment

Once you have submitted your initial payment you are agreeing to the Terms of Service in their entirety.

All billing is done via PayPal and Stripe. Invoices $10,000 or less must be paid in full before any work will commence. Invoices $10,001 or more will be split up into two payments - 50% deposit, with the remaining balance due upon completion. This is the policy unless special arrangements have been made.

Monthly Contracts

Invoices are sent prior to your due date. There is no grace period after the due date. Unpaid invoices will result in your contract being cancelled.

Refunds

Due to the nature of the services, Pretty Pages LLC will not issue refunds for any reason after a job has been started. Deposits secure your place on the calendar/schedule for the time agreed to on the invoice. Any projects cancelled by the client after time is scheduled where the project has not begun will incur a 50% cancellation fee of the deposit and the remaining deposit balance will be refunded immediately.

If Pretty Pages Web Studio is unable to start on a project due to unforeseen circumstances we will issue a refund accordingly, however once work has started no refunds will be issued.

Client Responsibility

You agree to provide us with everything that we need to complete the project including text, images and other information as and when we need it, and in the format that we ask for. You agree to review our work, provide feedback and sign-off approval in a timely manner too. Deadlines work two ways and you will also be bound by any dates that we set together. You also agree to stick to the payment schedule.

We have the experience and ability to perform the services you need from us and we will carry them out in a professional and timely manner. Along the way we will endeavor to meet all the deadlines set but we can’t be responsible for a missed launch date or a deadline if you have been late in supplying materials or have not approved or signed off our work on-time at any stage.

Pretty Pages LLC will make every effort to keep your project on schedule; however, we depend on your input and communication. A project that extends beyond 30 days from the projected completion date will be subject to additional charges.

Pretty Pages LLC is not associated nor responsible for client billing matters with third party services. You are responsible for keeping third-party accounts current.<

Website Update Policy for Clients on Monthly Plans

If you choose to update your website independently and this results in any technical issues or disruptions, our team will be available to assist you in resolving these problems. Please note that any necessary repairs or troubleshooting due to client-initiated updates will be billed at our standard hourly rate.

We recommend consulting with our team before making significant changes to your website to avoid potential issues and ensure optimal performance.

Copyright & Credit

You guarantee to us that any elements of text, graphics, photos, designs, trademarks, or other artwork that you provide us for inclusion in the web site are either owned by your good selfs, or that you have permission to use them. When we receive your final payment, copyright is automatically assigned as follows:

  • You own the graphics and other visual elements that we create for you for this project. We will give you a copy of all files and you should store them safely as we are not required to keep them or provide any native source files that we used in making them.
  • You also own text content, photographs and other data you provided, unless someone else owns them. We own the XHTML markup, CSS and other code and we license it to you for use on only this project.

Liability

Pretty Pages, LLC does not guarantee sales or success of websites.

We can’t guarantee that the functions contained in any web page templates or in a completed web site will always be error-free and so we can’t be liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate this web site and any other web pages, even if you have advised us of the possibilities of such damages.

Testing

We will test all our markup and CSS in current versions of all major browsers including those made by Apple, Microsoft, Mozilla, Google and Opera. We will also test to ensure that pages will display visually in a ‘similar’, albeit not necessarily an identical way. We will not test templates in old or abandoned browsers, for example Microsoft Internet Explorer 6 for Windows or Mac, previous versions of Apple’s Safari, Mozilla Firefox or Opera unless otherwise specified. If you need to show the same or similar visual design to visitors using these older browsers, we will charge you at the daily rate set out in our original estimate for any necessary additional code and its testing.

Revisions

We want to make sure that you are happy. Therefore there is no set limit on revisions. However, to make the process easy and to reduce revisions it is your responsibility to provide most, if not all, content in the beginning of the project.

If revisions become excessive due to not receiving items in a timely manner, Pretty Pages, LLC will reserve the right to charge for further design revisions at the hourly rate of $100/hr or the amount set out in the original estimate.

Because of the process that we approach when developing a website is very unlikely that you will need multiple revisions which is why we are confident that you will be happy.

Quotes

We know from plenty of experience that fixed-price contracts are rarely beneficial to you, as they often limit you to your first idea about how something should look, or how it might work. We don’t want to limit either your options or your opportunities to change your mind.

The estimate/quotation prices are based on the number of days and the hours that we estimate we’ll need to accomplish everything that you have told us you want to achieve. If you do want to change your mind, add extra pages or templates or even add new functionality, that won’t be a problem. You will be charged the hourly rate set out in the estimate we give you. Along the way we might ask you to put requests in writing (email) so we can keep track of changes.

Website and Marketing

Client agrees that design projects may be featured on Pretty Pages, LLC websites, social media, blogs, or promotional materials.

Design credit will be placed in the footer of all themes/templates created by or customized by Pretty Pages, LLC. The footer credit must remain intact for the duration of the use of the design. We reserve the right at any time to ask that our credits be removed if the design is changed in a way that we are uncomfortable with and is no longer a true reflection of our work.

Acceptance of Terms

By submitting your deposits/payments, you agree to the terms and conditions listed here. You are responsible for adhering to the terms and conditions listed here, even if you didn’t read them.
